Proposed Bylaw Amendment

Watercare Services Limited wishes to advise the following:

On 7 October 2010 the Special Board of Watercare Services Limited convened a meeting to deliberate and make a decision on the amendments to the Auckland Regional Council Trade Wastes Bylaw 1991 proposed in the Statement of Proposal. 

The Special Board decided not to proceed with the amendments proposed in the Statement of Proposal. 
 
The decision by the Special Board followed a consultation process in which interested parties made submissions on the proposed amendments. The Special Board received a recommendation from the Committee appointed to hear submissions on the proposed amendments. The Committee recommended that Watercare not proceed with the proposed amendments, for the following reasons:
 
(a) The significant level of customer concern at the speed and economic impact of change in trade waste charging in the district covered by the Bylaw;

(b) The uncertainty surrounding the legal and practical impact of Auckland local government reform on trade waste charges;

(c) The limited time available to consult on the complex issues raised by submitters on which there is a substantial variance of opinion;

(d) The desirability that decisions on trade waste charging policy issues be made by the Auckland Council unless there is a compelling case for a transitional amendment;

(e) The fact that the predicted impact of integration on trade waste customers covered by the Bylaw has turned out more favourably than anticipated (with a few exceptions), meaning that the reasons that grounded the Statement of Proposal are now less compelling.
 
The Special Board adopted these reasons in its decision not to proceed with the proposed amendments.

Watercare is continuing to work through the impact of the Auckland local government reforms that will take effect on 1 November 2010 and will continue to liaise with trade waste customers regarding this.

Proposed amendments to Auckland Regional Council Trade Wastes Bylaw 1991

We wish to advise that Watercare has adopted a statement of proposal to amend the Auckland Regional Council Trade Wastes Bylaw 1991 (“the Trade Wastes Bylaw”).

The Trade Wastes Bylaw regulates trade wastes within the Auckland region, including Waitakere City, Auckland City, Manukau City and Papakura District.  It does not apply to trade wastes in the North Shore, Rodney and Franklin areas.

Watercare has determined that amending the Trade Wastes Bylaw is appropriate to achieve equitable charging for trade waste services following the integration of wastewater services in Auckland on 1 November 2010.

Watercare welcomes submissions on the proposed amendments to the Trade Wastes Bylaw. Written submissions on the proposal must be made by 5.00pm on 30 July 2010.

Watercare will hold a public hearing in September 2010 to provide the opportunity for written submitters to speak to their submissions. Watercare will publicly notify the date, time and place of the hearing. Following the hearing Watercare will make its decision on whether the proposed amendments to the Trade Wastes Bylaw will proceed.
